Prices and Deposit
Prices are for the wholesale trade only and subject to change without notice. Material can be reserved with a 10% deposit. Another 40% is due upon harvest (3-4 weeks before delivery). Payment in full is due FOB.
Terms
All sales are on a cash basis unless credit has been approved prior to pick up or delivery of material. We accept cash, company checks, and all major credit cards. Payment of approved accounts is due within 30 days from date of invoice. A finance charge of 1.5% per month is charged on all past due accounts. Past due invoices will result in credit privileges being revoked. Checks returned for non-sufficient funds will be subject to a $50 service charge. All purchases made by check must also include the principal’s name, home address, driver’s license number, and date of birth.
Delivery
Valley-wide delivery is available at a rate of $3.85 per loaded mile with a $25 minimum delivery charge. Delivery to Corpus and further runs $2.85 per loaded mile. We are happy to arrange flatbed and reefer deliveries for you. Payment is required prior to unloading material. Customer or representative must be present to accept material. Customer is to provide adequate equipment and personnel at customer’s sole risk to unload material; driver is not responsible for unloading. Excessive waiting or unloading time will be billed at $30.00 per hour
Pickup Orders
We custom harvest trees for our customers and keep a limited supply of trees on our yard that are available for purchase. After an order is placed, we will notify you when your trees are ready for pick up. So that we can better serve you, customers should provide at least 2 days notice prior to pick up.
Warranty
Simmons Oak Farms, LLC gives no warranty, neither expressed nor implied. Trees are guaranteed to be healthy at time of shipment and true to name. All claims should be made within 24 hours of receiving material. A 10% re-stocking fee will be charged on all returns. Liability is limited to the purchase price.
Purchasing material from Simmons Oak Farms, LLC constitutes acceptance of all terms and conditions stated.
